Terms of Service

These Terms govern your access to and use of SwiftlyConnect. Please read them carefully.

1) Who we are & what we provide

SwiftlyConnect provides a lead-capture form and instant SMS notifications so local businesses can respond quickly to customer enquiries. Messages are transactional alerts, not marketing.

By using the service, you agree to these Terms and to our Privacy Policy.

2) Eligibility; your account

  • You are responsible for the accuracy of the contact phone number(s) you provide and for securing access to your account.
  • If you use the service on behalf of a business, you represent that you have authority to bind that business to these Terms.

3) Acceptable use

Use SwiftlyConnect responsibly. You must only send enquiry alerts that are triggered by a user’s request and that the recipient has expressly opted in to receive. The following rules apply:

  • No marketing or unsolicited messaging: Only first‑party, transactional enquiry alerts. No promotional content, upsells, or drip campaigns via this channel.
  • Consent requirements: Do not text any number without explicit, verifiable opt‑in. No purchased, rented, or scraped lists. Third‑party or blanket consents are not permitted.
  • Prohibited content (non‑exhaustive):
    • SHAFT categories: sexually explicit content; hate/harassment; alcohol (where restricted); firearms/ammunition; tobacco/vapes.
    • Cannabis, CBD, THC, kratom, or any federally/locally illegal substances.
    • Gambling, betting, sweepstakes, or lotteries (including tips/picks).
    • High‑risk financial offers: payday loans, short‑term/high‑interest loans, debt relief/settlement, credit repair, student‑loan consolidation, get‑rich‑quick schemes.
    • Phishing, malware, scams, or deceptive practices; impersonation of another person or brand.
    • Affiliate marketing, multi‑level marketing (MLM), lead selling/resale or brokering of third‑party leads.
    • Counterfeit goods, illegal products/services, or facilitation of unlawful activity.
    • Medical/health content that includes protected health information (PHI) or requests for diagnosis/treatment over SMS.
    • Sensitive identifiers or financial data over SMS (e.g., full card/PAN, CVV, bank account/routing numbers, government ID numbers).
  • Message formatting: Include clear sender identification (“SwiftlyConnect”) and support standard keywords in every SMS: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to unsubscribe; HELP or INFO for help.
  • Compliance: You must comply with all applicable laws and carrier/industry rules (e.g., CTIA guidelines and U.S./Canadian Toll‑Free policies). We may monitor, filter, or block traffic that violates these rules or threatens network reliability.

Carrier disclaimer: Delivery is subject to carrier networks and may vary or be delayed; carriers are not liable for delayed or undelivered messages.

4) Messaging terms (important)

  • Message frequency: one message per enquiry (additional messages only if you trigger them).
  • Opt-out: Reply STOP to unsubscribe from future SMS to that number.
  • Help: Reply HELP for help.
  • Charges: Message and data rates may apply.

5) Fees, billing & taxes

We may offer pay-per-lead, flat-fee, or other plans as shown at checkout or onboarding. Prices exclude taxes unless stated. You authorise us (and our payment processor) to charge the payment method on file.

If a payment fails or an invoice is overdue, we may suspend or limit the service until payment is resolved.

6) Fair use & anti-abuse

We monitor for abuse and may throttle, filter, or block traffic that threatens network reliability, violates carrier rules, or degrades the experience for others.

7) Third-party providers

We use reputable messaging, hosting, analytics, and payment providers to deliver the service. They process data on our behalf in accordance with our Privacy Policy.

8) Suspension & termination

You may stop using the service at any time. We may suspend or terminate the service (or your access) if you materially breach these Terms, cause legal risk, or engage in abuse or unlawful activity. We will try to give notice where reasonable.

9) Disclaimers

The service is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation or that messages will be delivered in all cases.

10) Limitation of liability

To the maximum extent permitted by law, our total liability for any claims relating to the service will not exceed the amounts you paid to us for the service in the 3 months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenues, data, or goodwill.

11) Indemnity

You agree to defend, indemnify, and hold us harmless from claims arising out of your misuse of the service, your content, or your violation of these Terms or applicable laws.

12) SwiftlyConnect Lead Alerts (US/CA Toll-Free SMS Program)

This section describes our SMS notification program for businesses who use SwiftlyConnect to receive enquiry alerts.

  • Purpose: Transactional SMS to notify you (the business) of new website enquiries captured via SwiftlyConnect. These are not marketing messages.
  • Message frequency: One message per enquiry (additional messages only if you trigger them).
  • Opt-out: Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to stop receiving messages.
  • Help: Reply HELP or INFO for help.
  • Charges: Message and data rates may apply.
  • Sender ID: All messages identify SwiftlyConnect in the body of the SMS.

  • Carrier disclaimer: Delivery is subject to carrier networks and may be delayed or undelivered; carriers are not liable for delayed or undelivered messages.

13) Governing law & disputes

These Terms are governed by the laws of Ireland, without regard to conflict-of-laws principles. Courts located in Ireland will have exclusive jurisdiction, and you consent to their personal jurisdiction. If you are a consumer with mandatory local rights, those rights remain unaffected.

14) Changes to these Terms

We may update these Terms to reflect changes to the service or the law. We will post the new version here with the date above. If changes are material, we will provide additional notice.
