SwiftlyConnect is designed to help website visitors start direct conversations with businesses. These Terms explain what SwiftlyConnect provides, what it does not provide, and where responsibility sits once a visitor contacts a business.
By using SwiftlyConnect, you agree to these Terms.
Built for businesses
These Terms apply to businesses that use SwiftlyConnect to improve contact from their websites.
Direct communication
Visitors contact the business directly through the business's own contact methods.
Subscription service
SwiftlyConnect operates as a subscription service and requires an active subscription to continue operating.
1. About SwiftlyConnect
SwiftlyConnect is a business service designed to help website visitors contact businesses more easily.
SwiftlyConnect may be provided as a done-for-you installation service, or customers may choose to install and maintain certain components themselves where available.
Who these Terms apply to
These Terms apply to businesses that use SwiftlyConnect and the services we provide.
2. What SwiftlyConnect does
SwiftlyConnect helps businesses make it easier for website visitors to start a conversation.
SwiftlyConnect is intended to increase opportunities for direct communication between businesses and their customers.
Depending on the implementation, SwiftlyConnect may:
- Provide website contact features
- Help visitors initiate contact
- Connect visitors with a business's existing communication methods
- Provide installation, configuration, maintenance, and support services
- Provide limited usage and interaction reporting
3. What SwiftlyConnect does not do
SwiftlyConnect is not a messaging platform, CRM, lead management system, customer support platform, call centre, or communications provider.
No message handling
- We do not receive customer messages
- We do not store customer conversations
- We do not provide a shared inbox
No relationship management
- We do not route customer enquiries
- We do not manage customer relationships
- We do not negotiate transactions
No middleman role
Once a visitor chooses to contact a business, the communication takes place directly between those parties.
4. Business customer communications
If a website visitor sends a text message, email, WhatsApp message, makes a phone call, or otherwise contacts a business using contact methods supported by SwiftlyConnect, that communication takes place directly between the visitor and the business.
SwiftlyConnect is not a participant in those communications and is not responsible for their content, outcome, accuracy, timing, or conduct.
5. Customer transactions
SwiftlyConnect is not a broker, agent, marketplace, reseller, representative, or intermediary in transactions between businesses and their customers.
Any quotation, booking, purchase, service agreement, payment, warranty, complaint, refund request, dispute, or other transaction exists solely between the business and its customer.
Business responsibility
Businesses remain solely responsible for their services, products, representations, communications, and customer relationships.
6. Subscription & billing
SwiftlyConnect is provided on a subscription basis.
Subscription fees are billed in advance using the payment method associated with the account.
Customers may cancel their subscription at any time.
Active subscription required
Continued operation of SwiftlyConnect requires an active subscription.
Pricing, service plans, and available features may change from time to time. Any material pricing changes will be communicated in advance.
7. Suspension & cancellation
If payment cannot be collected, SwiftlyConnect may provide a reasonable opportunity for the customer to update payment information or resolve the issue.
Payment issues
If payment issues are not resolved, SwiftlyConnect may suspend or discontinue the service until the account is returned to good standing.
Service functionality
Suspension or cancellation may result in SwiftlyConnect features no longer appearing or functioning on the customer's website.
Ending the relationship
Either party may terminate the service relationship where continued provision of the service is no longer practical or appropriate.
8. Acceptable use
SwiftlyConnect may refuse, suspend, or terminate service where we reasonably believe continued operation would be unsuitable for the service.
This includes use that is:
- Unlawful
- Fraudulent
- Deceptive
- Abusive
- Harmful to users
- Harmful to the reputation of SwiftlyConnect
- Inconsistent with these Terms
- Otherwise unsuitable for the service
Website changes matter
This includes situations where a website changes ownership, purpose, content, or operation after installation.
SwiftlyConnect may decide that continued operation on a website is no longer appropriate, even if the service was originally approved or installed for that website.
9. Installation & website responsibility
SwiftlyConnect is responsible for the SwiftlyConnect service itself.
Customers remain responsible for their own website, hosting, content, domain names, third-party software, website security, and website maintenance.
Self-installation or modification
Where a customer chooses to install, modify, or maintain SwiftlyConnect components themselves, the customer assumes responsibility for those changes and any resulting issues.
SwiftlyConnect is not responsible for problems caused by customer modifications, third-party changes, hosting issues, website errors, or systems outside our control.
10. Service availability
We work to keep SwiftlyConnect available and operating reliably. However, no online service can guarantee uninterrupted availability at all times.
Availability can be affected by:
- Maintenance
- Software updates
- Infrastructure failures
- Internet disruptions
- Third-party outages
- Browser changes
- Hosting issues
- Other factors outside our control
Designed to fail gracefully
SwiftlyConnect is designed to operate independently of the customer's website and to fail gracefully if the service becomes unavailable.
The intended behaviour is that SwiftlyConnect features cease functioning while the remainder of the customer's website continues to operate independently.
We do not guarantee uninterrupted availability or error-free operation.
11. Credits, refunds & remedies
If a significant service interruption occurs due to an issue within SwiftlyConnect, we may provide credits, refunds, subscription extensions, or other remedies at our discretion.
Discretionary remedies
Nothing in this section creates an obligation to provide any specific refund, credit, or compensation.
12. Limitation of liability
To the maximum extent permitted by law, SwiftlyConnect shall not be liable for lost profits, lost revenue, lost business opportunities, loss of goodwill, indirect damages, consequential damages, special damages, or incidental damages.
SwiftlyConnect is not responsible for losses arising from customer communications, customer transactions, third-party services, website issues, hosting failures, or circumstances outside our reasonable control.
Liability cap
To the maximum extent permitted by law, SwiftlyConnect's total liability arising from or relating to the service shall not exceed the total fees paid by the customer to SwiftlyConnect during the twelve months preceding the event giving rise to the claim.
13. Changes to the service and Terms
SwiftlyConnect may modify, improve, replace, suspend, or discontinue parts of the service from time to time.
We may also update these Terms when the service, business, or legal requirements change.
Updated Terms
Updated Terms will be posted on this page together with a revised effective date.
Continued use of SwiftlyConnect after changes take effect constitutes acceptance of the updated Terms.
14. Governing law
These Terms shall be governed by and interpreted in accordance with the laws of Ireland.
